E-Statements and Electronic Records Disclosure and Agreement

By clicking I Accept, you confirm that you have read the terms and conditions, that you understand them and that you are in compliance with them.  YOU WILL NO LONGER RECEIVE A PAPER STATEMENT OR PAPER NOTICES IN THE MAIL.

 

This Agreement describes your rights and obligations as a user of the E-Statement and Electronic Records Service ("Service").  Please read this Agreement carefully.  By pressing the “I Accept” button and providing your consent below, you:

·         Acknowledge receipt of this E-Statement and Electronic Records Services Agreement;

·         Agree you have read this agreement and consent to electronic delivery of all account statements;

·         Agree you have read this agreement and consent to electronic delivery of all other disclosures, notices, letters, and any other information that may be required by state or federal law, or that we provide relating to your accounts, loans, or other products and services with us;

·         Agree you have read this agreement and consent to the electronic delivery of all tax forms that may be provided electronically in accordance with state or federal law;

·         Agree to no longer receive paper copies of all account statements, all other disclosures, notices, letters, and other information, and all tax forms that may be provided electronically in accordance with state or federal law until your consent to electronic delivery of such items is withdrawn, except upon request as described below. 

 

If you do not want to receive your account statements, disclosures, notices, letters, tax forms, and other information electronically, you should exit this agreement and leave this area of our website.  If you do not agree to receive your account statements, disclosures, notices, letters, tax forms, and other information electronically, we will send you paper copies.

Other Federal and State statutes may be enacted or amended in the future to provide for electronic delivery of account statements. Your acceptance below also authorizes us, at our discretion, to provide electronic delivery of such statements pursuant to these statutes after they become effective. You further agree to comply with the supplemental terms and conditions set forth in this Agreement, which are set forth below.

 

Definitions

“E-Statement”, “E-Statement and Electronic Records Service”, or simply “Service” means the internet-based service in which Tech Credit Union delivers periodic encrypted account statements, disclosures, notices, letters, tax forms, and other information to a secure website.

 

“We”, “our”, and “us” means Tech Credit Union. 

 

“You” and “your” means the account owner(s) and anyone else with the authority to view, deposit, withdraw, or exercise control over funds in the account.  If there is more than one account owner or person with such authority, notice to any one account owner or person with such authority is effective for all.

 

Consent

Your consent to the electronic delivery of your account statements, disclosures, notices, letters, tax forms, and other information is required in order to be able to receive them electronically.  Your consent will allow us to provide these documents to you electronically until your consent is withdrawn, and we will no longer deliver this information to your mailing address. 

 

Right to Withdraw Your Consent

You have the right to withdraw your consent to receive account statements, disclosures, notices, letters, tax forms, and other information electronically at any time.  You may withdraw your consent by any of the following means:

·         Log into your Online Banking Account and click on “E-Statements” under “Manage Money”.  Click “My Profile” and choose “Printed Statements”.  Your e-statements will be cancelled and you will receive a paper statement (fees apply). 

·         Call the Contact Center at 1-800-276-8324 between 9:00 am and 5:00 pm CST Monday-Friday.

·         Send us your request in writing, including your name, address, and phone number, to:

Option to Obtain Paper Copies

You may obtain a paper copy of account statements, disclosures, notices, letters, tax forms, and other information provided to you electronically, without withdrawing your consent to receive such information electronically, by calling our Contact Center at 1-800-276-8324.  Paper copies will be provided to you only upon request and we may charge you a fee for providing a paper copy. 

 

Access to Services

You will gain access to your e-statement and electronic records through the use of your Internet-enabled device, your Internet Service Provider, and your Online Banking logon information.

 

Security Measures

We will use commercially reasonable measures, consistent with industry standards, to maintain a reasonable level of security over the information contained in the electronically delivered account statement(s). Our security consists of 128-bit encryption of the data contained in the electronic statement to protect it while in transit over the Internet.

 

You understand that these industry standards are dynamic and constantly developing.  BY ACCEPTING THIS AGREEMENT, YOU ACKNOWLEDGE AND UNDERSTAND THERE ARE RISKS TO ELECTRONIC DELIEVERY OF ACCOUNT STATEMENTS, DISCLOSURES, NOTICES, LETTERS, TAX FORMS, AND OTHER INFORMATION INCLUDING, BUT NOT LIMITED TO, DELAY OR FAILURE OF DELIVERY DUE TO TECHNICAL DIFFICULTIES, WEATHER CONDITIONS, MATTERS BEYOND OUR REASONABLE CONTROL, AND INTERCEPTION OR ALTERATION OF SUCH ACCOUNT DOCUMENTS BY THIRD PARTIES, DESPITE OUR COMMERCIALLY REASONABLE SECURITY MEASURES.

By accepting this agreement, you represent that you have considered our security measures, and find that our security measures are commercially reasonable. In reaching this conclusion, you have considered the historical and potential future content of your statement(s) and other electronic records, the risks associated with electronic delivery of account statement(s) and other electronic records, and our security procedures. If you conclude that our security procedures cease to be commercially reasonable in the future, you must terminate this agreement immediately in accordance with the procedure outlined below.

 

Hardware and Software Requirements

You are responsible for obtaining, installing, maintaining, and operating all computer hardware and software necessary for receiving e-statements and other electronic records.  Tech Credit Union will not be responsible for any errors or failures from the malfunction or failure of your hardware or software. 

 

Before consenting to receive your account statements, disclosures, notices, letters, tax forms, and other information electronically, you must determine if you have the necessary hardware and software to access and retain this information.  You must have a computer or other device such as a smartphone or tablet that is capable of accessing the internet, and you must have an active account with an internet service provider.  Your access to this page verifies that your system meets these requirements.  Your computer will need one of the following web browser applications on the most current version:

·         Microsoft Edge

·         Firefox

·         Google Chrome

 

You will also need software that permits you to receive and access Portable Document Format (“PDF”) files, such as Adobe Acrobat Reader, available for downloading at https://get.adobe.com/reader/.  Your access to this page verifies that your system has the necessary software to permit you to receive and access PDF files. 

 

You will also need the ability to either download to an electronic storage medium or print to a functioning printer that is connected to a computer or other access device.

 

On a cellphone, IPad, or tablet, download the Tech Credit Union app from the APP Store for Apple devices and Google Play for Android devices.

 

E-mail Address

As a convenience to you, we will send notification of availability of your periodic account statement(s) and other electronic records to you via e-mail to the last known e-mail address provided by you. You agree to notify us promptly of any change of your e-mail address using the procedures set forth below. If you have not notified us in writing of any change to your e-mail address, you agree that your failure to provide us with a good e-mail address is the lack of ordinary care on your part, and we will not be responsible for any loss that occurs as a result of this failure. Your e-statements and other electronic records will be available in your online account even if you do not access the email that is sent to notify you of the availability of the e-statements and other electronic records. 

 

Use of your Security Password

You agree not to allow anyone to gain access to the Service or to let anyone know your password used with the Service. You further agree that Tech Credit Union has no control as to the persons who have access to your device and your password, nor do we have control over who you share your login information with. Tech Credit Union will not be liable for any unauthorized access to your online account using your password. You agree that it is your responsibility to initiate and maintain the highest level of password security procedures to prevent any unauthorized access to your online account or unauthorized use of your password.

 

Notice of Unauthorized Access

If you believe your electronic statement has been lost or stolen, or that someone has obtained access to your electronic statement without your permission, immediately call Tech Credit Union’s Contact Center at 1-800-276-8324 between 9:00 a.m. and 5:00 p.m. CST Monday-Friday.  

 

Changing Your Security Password / E-mail Address

You must promptly notify us of any changes in the email address, mailing address, phone number, or other contact information you have provided to us.  You have an ongoing obligation to ensure all of your contact information with us is current and valid.  To update your email address, residential address, mailing address, or phone number you must notify us in writing. 

 

Access to your electronic statements and records is through single sign-on in online banking.  To reset your password, click the “Forgot/Change Password” selection when signing in to online banking.   Tech Credit Union shall have no obligation or liability to any of the parties of a multiple ownership account if the e-mail address and/or password is changed by another owner/authorized user of the account.

 

Prompt Review

You must promptly review your e-statement, other electronic records, and any accompanying items. If you allow someone other than you to review your statements, you must still review the statement for any errors, unauthorized signatures, lack of signatures, alterations, or other irregularities, as you are responsible for the wrongful acts of your employees and agents. If you discover any errors, unauthorized signatures, lack of signatures, alterations or other irregularities, you must promptly notify us in writing of the relevant facts at the address listed below:

Any applicable time periods within which you must notify us of any errors or applicable time periods in which you must respond to us, will begin on the date your account statements, disclosures, notices, letters, tax forms, and other information are first made available to you in our Online Banking service, regardless of when you receive or access such information. 

 

Account Closing

If you close your accounts at Tech Credit Union, access to your online banking information will immediately be terminated.  Your statement selection will be changed to “Paper” and you will receive your final statement via U.S.P.S. 

 

Limit of Tech Credit Union and Other Provider's Responsibility

YOU ACKNOWLEDGE AND UNDERSTAND THERE ARE RISKS TO ELECTRONIC DELIVERY OF ACCOUNT STATEMENTS, DISCLOSURES, NOTICES, LETTERS, TAX FORMS, AND OTHER INFORMATION INCLUDING, BUT NOT LIMITED TO, DELAY OR FAILURE OF DELIVERY DUE TO TECHNICAL DIFFICULTIES, WEATHER CONDITIONS, MATTERS BEYOND OUR REASONABLE CONTROL, AND INTERCEPTION OR ALTERATION OF SUCH ACCOUNT DOCUMENTS BY THIRD PARTIES, DESPITE OUR COMMERCIALLY REASONABE SECURITY MEASURES.  We shall have no liability for any consequential, special, or punitive damages or indirect loss under any circumstances.  Tech Credit Union is not responsible for any computer virus or related problems, which may be attributable to the Service.

 

BY CONSENTING TO THE ELECTRONIC DELIVERY OF YOUR ACCOUNT DOCUMENTS, YOU REPRESENT THAT YOU HAVE CONSIDERED OUR SECURITY MEASURES AND FIND THAT THEY ARE COMMERCIALLY REASONABLE.  IF YOU, AT A LATER DATE, CONCLUDE THAT OUR SECURITY PROCEDURES CEASE TO BE COMMERCIALLY REASONABLE, YOU MUST TERMINATE THIS AGREEMENT IMMEDIATELY IN ACCORDANCE WITH THE PROCEDURES DESCRIBED ABOVE IN THE SECTION TITLED “RIGHT TO WITHDRAW YOUR CONSENT”. 

 

YOU ACKNOWLEDGE THAT YOU ARE CONSENTING TO ELECTRONIC DELIVERY OF YOUR ACCOUNT STATEMENTS, DISCLOSURES, NOTICES, LETTERS, TAX FORMS, AND OTHER INFORMATION AT YOUR OWN RISK.  OUR WEBSITE, THE CONTENT AVAILABLE ON OR THROUGH OUR WEBSITE, AND THE SOFTWARE MADE AVAILABLE ON OR THROUGH OUR WEBSITE IF APPLICABLE, ARE PROVIDED “AS IS” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND.  WE DO NOT WARRANT THAT THE SOFTWARE PROGRAM OR THE ELECTRONIC DELIVERY SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS.  TECH CREDIT UNION AND ITS AFFILIATES HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESSED AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OR RELIABILITY, ACCURACY, TITLE, MERCHANTABILITY, NON-INFRENGEMENT, FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER WARRANTY, CONDITION, GUARANTEE, OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY CONTENT CONTAINED THEREIN OR PROVIDED THROUGH THE WEBSITE.  TECH CREDIT UNION DOES NOT REPRESENT OR WARRANT THAT ELECTRONIC ACCESS TO ACCOUNT DOCUMENTS WILL BE UNINTERRUPTED OR WITHOUT FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED THROUGH THE WEBSITE.  TECH CREDIT UNION IS NOT RESPONSIBLE OR LIABLE FOR USER CONTENT OR OTHER CONTENT POSTED BY THIRD PARTIES, ACTIONS OF THIRD PARTIES, OR FOR ANY DAMAGE TO YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY. 

 

WE ARE NOT LIABLE IN CONTRACT, TORT, OR OTHERWISE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR INDIRECT LOSS UNDER ANY CIRCUMSTANCES.  EXCEPT TO THE EXTENT THAT WE ARE FOUND LIABLE UNDER THIS AGREEMENT, YOU AGREE TO INDEMNIFY AND HOLD US AND OUR DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS HARMLESS FROM ALL CLAIMS, DEMANDS, JUDGMENTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE PERFORMANCE OF THE SERVICES DESCRIBED IN THIS AGREEMENT.  YOU AGREE THAT THE RIGHTS AND OBLIGATIONS OF THIS SECTION WILL SURVIVE TERMINATION OF THE AGREEMENT. 

 

Electronic Mail

You agree that Tech Credit Union may respond to you by electronic mail with regard to any matter related to the Service. Any such electronic mail sent to you by Tech Credit Union shall be considered received within three (3) days of the date sent by Tech Credit Union, regardless of whether or not you sign on to your specified e-mail account within that time frame.

 

If you send Tech Credit Union an electronic mail message, Tech Credit Union will be deemed to have received it on the following business day. Tech Credit Union will have a reasonable time to act on your e-mail.  You should not rely on electronic mail if you need to communicate with Tech Credit Union immediately (e.g., if you need to report an unauthorized transaction from one of your accounts, etc.).

 

Other agreements

In addition to this Agreement, you agree to be bound by and comply with the requirements of the agreements applicable to each of the accounts for which you elect to receive electronic statements and other electronic documents. Your use of the E-Statement and Electronic Records Service is your acknowledgment that you have received these agreements and intend to be bound by them. You should review the disclosures associated with all your accounts at Tech Credit Union and notify us if you have any questions.

 

Modifications to this Agreement

Tech Credit Union may, in our sole discretion, terminate or modify the terms and conditions applicable to the Service or suspend providing you with electronic delivery of account statements, disclosures, notices, letters, tax forms, and other documents that may be provided electronically in accordance with federal or state laws and regulations.  We will ordinarily send you notice of any suspense or termination, but we are not required to do so unless applicable law requires such notice.  You are not permitted to alter or amend this agreement or any related document without our express written consent; any attempt to do so will be void and unenforceable.  We may provide any notice to you via electronic delivery and you will have been deemed to receive it at the time it is available.  We reserve the right to terminate this Agreement and your use of the Services in whole or in part at any time without prior notice. 

 

Fee Schedule

Tech Credit Union offers the benefits and convenience of the Service to you free of charge.  We reserve the right to update and/or change the fee schedule for e-statements at any time.  You will be provided at least thirty days’ notification of any change in fees applicable to the service. 

 

Governing Law

This Agreement shall be construed in accordance with any applicable federal laws and the internal laws of the State of Indiana.  If any terms of this agreement cannot be legally enforced, they will be considered changed to the extent necessary to comply with applicable law and the remaining provisions of this agreement and the application of the challenged provision will not be affected thereby, and each of those provisions will be valid and enforceable to the full extent permitted by law. 

 

CONSENT AND ACKNOWLEDGEMENT

BY AGREEING BELOW, YOU ACKNOWLEDGE THAT YOU CAN ACCESS AND RETAIN THE ELECTRONIC RECORDS IN THE FORMAT DESCRIBED ABOVE AND YOU CONSENT TO TECH CREDIT UNION PROVIDING YOU WITH ACCOUNT STATEMENTS, DISCLOSURES, NOTICES, LETTERS, TAX FORMS, AND OTHER INFORMATION THAT MAY BE REQURIED BY FEDERAL OR STATE LAW OR REGULATION ELECTRONICALLY.
